These general conditions regulate the purchase of the products and/or services offered on the site www.ingubalcanis.com (hereinafter the website), property of Innovación en gestión y conservación de ungulados, S.L., with address at C/ Miguel Servet, 11-13, 10004, Cáceres, Spain, CIF B-10412484. (hereinafter the PROVIDER).

It also regulates the rights and obligations of the parties deriving from the purchase and sale transactions entered into between them.

Any person accessing this website assumes the role of user (hereinafter THE USER), the acquisition of any of the products or services implies full and unreserved acceptance of each and every one of the General Conditions indicated without prejudice to the acceptance of the Special Conditions that may be applicable to the acquisition of certain products or services.

The acceptance of the purchase by THE USER implies the manifestation of his willingness to purchase our products or services and gives full effect to the purchase contract entered into between the parties.
These General Conditions may be modified without prior notice, therefore, it is advisable to read their contents carefully before proceeding with the purchase of any of the products or services offered.

All notifications and communications between THE USER and THE PROVIDER shall be considered effective, for all purposes, when made through any of the means detailed above.

PRODUCTS AND/OR SERVICES

The products and/or services offered, together with their main characteristics and price are displayed on the screen.

THE PROVIDER reserves the right to decide at any time the products and services offered to THE USER. Thus, the PROVIDER may at any time add new products or services to those currently offered. It also reserves the right to withdraw or cease to offer at any time and without prior notice any of the products or services offered.

Once inside the website and to access the purchase of the different products or services, THE USER must follow all the instructions indicated in the purchase process.
The availability, description and price of each item can be consulted in the product or service description and are valid except when out of stock or typographical error.

PURCHASING PROCESS

To make any purchase on the website, it is necessary that the USER is of legal age and has the capacity to contract. In addition, it will be necessary to register through a data collection form in which all the information necessary for the purchase is provided to the PROVIDER; data that in any case will be truthful, accurate and complete about your identity and that the USER must expressly consent to by accepting our Privacy Policy.

For the correction of possible errors in your data, you can access your user file using the name and password provided/chosen and proceed with the correction.

The steps to follow to make the purchase are as follows:

  1. Select products or services.
  2. Click on the “add to cart” button.
  3. Confirm your order.
  4. Register if you are not already registered. (You will receive the confirmation to the indicated e-mail)
  5. Indicate the shipping method
  6. Indicate method of payment.
  7. Click on “Order with obligation to pay”.
  8. Click “click” to accept if all the data is correct and follow the instructions depending on the payment method.

The PROVIDER will electronically store the order and it will be available to you in your control panel which you can access at any time with the name and password provided/chosen in the registration process.
It is recommended that THE USER print and/or keep a copy on a durable medium of the proof of receipt that he/she will receive by e-mail indicated in the registration process immediately after confirming his/her purchase.

 

BILLING

Upon request, you will receive an invoice together with your order. By default it will be sent to the e-mail address provided during the registration process.

 

SECURITY AND BUYER PROTECTION

Ingubalcanis.com uses security systems in transactions through secure banking payment gateways. SLL protocols are complied with. Our payment gateways use the 3DSecure system redirecting your data to secure servers without the merchant being able to access or store it.

 

DELIVERY OF PRODUCTS

Your order will be prepared for shipment as soon as your payment has been confirmed, and will be available for shipment within 48-72 hours at the latest (working days, excluding Saturdays, Sundays and holidays). If you need confirmation of departure, please do not hesitate to request it.

Transit times depend on the location of the delivery address indicated by the user. Approximately these terms will be, once they leave our facilities, those indicated in the purchase process and more specifically:

Spain peninsula: 1 to 3 days.
Balearic and Canary Islands: 2 to 5 days.

If upon receiving our order at your home you notice that the packaging arrives broken or damaged, you have to check that the items inside are in perfect condition: neither broken nor damaged, indicating it, in any case, in the delivery note of receipt of the goods as an observation.

If they arrive damaged or broken due to transport, you must notify the courier of the transport company and also detail it on the delivery note.
THE PROVIDER guarantees that all its products have been shipped from our warehouse in perfect condition and with the packaging free of defects. If any of the two circumstances mentioned above (delivery defects) occur, you must notify us so that we can claim the damage caused to the transport insurance and study the case. In either case, you may choose to exchange the product or to receive a refund of the amounts paid.

If the reception of the orders is delayed beyond the contracted time due to causes attributable to the transport company, the PROVIDER is not responsible for this delay, being the transport company responsible in any case.
The PROVIDER shall not be liable for delays caused as a consequence of acts beyond its control, including but not limited to: weather conditions, strikes, blockades, customs incidents, force majeure. We will let you know as soon as possible if they are known or can be foreseen.

 

ORDER TRACKING.

(Not always available) It is essential to provide a valid email address for the tracking of the order, the transport companies will send to this email the locator and the web address or URL where you can find the location of the order.
By default we will always use the email address that I indicated in the registration process.

 

PRODUCT AVAILABILITY AND SUBSTITUTIONS

THE PROVIDER intends to guarantee the availability of all products that are advertised. However, in the event that any requested product is not available or if the product is out of stock due to exceptional circumstances of multi interactive order or those others that cause the end of stock of the product THE USER may choose to:

  • Acquire a product with similar characteristics.
  • Wait to replenish stock.
  • Refund of the amount paid, if applicable.

In the latter case, the order and the contract signed between the parties shall be without effect by virtue of this termination clause, fully restoring to the customer in case of prepayment the amounts paid by the same, without any compensation in favor of any of the parties for breach of contract, consequential damages or loss of profits, nor shall the payment made by the customer be understood as a deposit.

Orders will be cancelled in any of these cases:

  • Delivery cannot be made when delivery is attempted three times.
  • It has not been possible to contact the customer within 9 business days after the first unsuccessful delivery attempt.
  • The amount of the order has not been transferred within ten working days after the order date.

Users who place cash on delivery orders that are not picked up and are returned by the carrier for no reason will not be able to return to make any purchase through this website.

 

PRICES, EXPENSES AND TAXES

The prices of the products or services expressed on the web site are inclusive of VAT in force at the time of the same.
At the time of placing the order, they shall be added and itemized. In any case, the invoice that the customer will receive will clearly identify the tax base, the tax rate, the amount of the tax, any other expenses such as transport or additional expenses due to the method of payment to be paid, as well as the invoice total.
Orders will be processed on a first-come, first-served basis.

 

SHIPPING COSTS

The cost of shipments depends on the destination, the volume and weight of the order, as well as the urgency of delivery. However, prior to order confirmation, this information will be displayed and the corresponding invoice will be detailed.

 

PAYMENT METHODS

The following payment methods are available:

  1. By credit card, just provide us with your credit card number and expiration date. In this case, your data will be encrypted and sent under secure server to our bank’s POS. If any refund or cancellation of the order is necessary, the amount will be reimbursed through the same payment card.
  2. PayPal is a U.S. company belonging to the e-commerce sector that allows the transfer of money between users who have e-mail, an alternative to the traditional paper method such as checks or money orders.

RETURN AND CANCELLATION POLICY

According to the regulations, THE USER shall have the right to WITHDRAW from the contract for a maximum period of 14 calendar days (from the day of receipt and according to the official calendar of the place where the good has been delivered), without the need to indicate the reason, through the logistics operator that supplied it and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007, of November 16, which approves the referred text of the General Law for the Defense of Consumers and Users.
During this period, THE USER may communicate to THE PROVIDER his decision to withdraw from the contract by sending a communication to the e-mail or postal address provided in these general conditions, and may withhold the refund until he has received the products or proof of the return.

The USER must return the products at the latest within 14 calendar days from the date on which he/she communicated his/her decision to withdraw.
The PROVIDER shall communicate to the USER on a durable medium an acknowledgement of receipt of such withdrawal.

The withdrawal implies that the PROVIDER will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days after receiving the product (material delivery of the good) or having contracted the service, following the same procedure chosen for its payment or through the one indicated by the USER.

The USER must return the products at the latest within 14 calendar days from the date on which he/she communicated his/her decision to withdraw.

In the event that the USER exercises the right of withdrawal, the cost of return shall be borne by the USER.

To proceed with the return of a product it is essential that it is in perfect condition and with its original packaging, with all its accessories and without having been used.

To determine the nature, characteristics and functioning, THE USER shall only carry out such manipulations and inspections of the goods as would be admitted in a commercial establishment.

It is mandatory to return the products properly protected, in their original packaging, in perfect condition, no package will be accepted if it lacks any of the sender’s identification elements (name, surname, address, order number).

To exercise this right of withdrawal, you must send an e-mail to canis@ingulados.com or by ordinary mail to Ingulados S.L., C/ Miguel Servet, 11-13, Parque Empresarial Mejostilla, CP: 10004, Cáceres, stating the following data:

WARRANTY

If you believe that the information that appears in the articles of our store is insufficient, please ask us to expand them by contacting our Customer Service through the channels indicated in these general conditions.
Excluded from warranty are consumable products, deficiencies caused by improper use or manipulation, connection to the mains other than that indicated, incorrect installation or defects resulting from any external cause.

 

CUSTOMER SERVICE AND COMPLAINTS

In order to file any complaint or claim before the PROVIDER, the USER must contact the customer service department through the contact channels established in these general conditions.

There is the possibility of resorting to an out-of-court complaint mechanism established in Regulation (EU) No 524/2013 of the Parliament and of the Council of 21 May 2013 and to which you will have access through the following link:

The parties shall submit to the following courts and tribunals for the resolution of any conflicts that may arise between them, renouncing any other jurisdiction:
a. In the event that THE USER is a consumer, the courts and tribunals of the domicile of said user shall have jurisdiction.

  1. In the event that the purchaser is an entrepreneur, the courts and tribunals closest to the PROVIDER’s domicile shall have jurisdiction.

 

NULLITY AND INEFFECTIVENESS OF THE CLAUSES

If any clause included in these conditions is declared totally or partially null or ineffective, such nullity shall only affect such provision or the part thereof that is null or ineffective, and the conditions shall survive in all other respects.

 

PERIOD OF VALIDITY OF THESE CONDITIONS

The period of validity of these conditions will be the time they remain published on the website and will apply to products purchased at the time these conditions were available.

In any case, the PROVIDER reserves the right to modify them unilaterally, without affecting the products contracted by the USER prior to the modification.

 

APPLICABLE LAW

The present conditions shall be governed by Spanish law. For the resolution of any doubt, discrepancy or divergence that may arise in the performance or interpretation of this document, the courts and tribunals of the province of El Salvador shall have jurisdiction.

 

PROVIDER

The language used for the formalization of the contract is Spanish.
